3.3 If payment of the price or any part thereof is not made by the due date, the Seller shall be entitled to:

3.3.1 require payment in advance of delivery in relation to any Goods not previously delivered;

3.3.2 refuse to make delivery of any undelivered Goods whether ordered under the contract or not and without incurring any liability whatever to the Buyer for non-delivery or any delay in delivery;

3.3.3 terminate the contract.
3. PREIS UND ZAHLUNG

3.1 Der Preis entspricht dem aktuellen Listenpreis des Verkäufers oder einem anderen Preis, den die Parteien schriftlich vereinbaren können. Der Preis versteht sich zuzüglich Mehrwertsteuer oder sonstiger anfallender Kosten.

3.3 Erfolgt die Zahlung des Preises oder eines Teils davon nicht bis zum Fälligkeitstag, ist der Verkäufer zu folgendem berechtigt:

3.3.1 eine Vorauszahlung für nicht gelieferte Waren zu verlangen;

3.3.2 es abzulehnen, nicht gelieferte Waren zu liefern, unabhängig davon, ob sie im Rahmen des Vertrags bestellt wurden oder nicht, und ohne dass dem Käufer eine Haftung für Nichtlieferung oder Lieferverzögerung auferlegt wird;

3.3.3 den Vertrag zu kündigen.
4. DELIVERY

4.1 Unless otherwise agreed in writing, delivery of the Goods shall take place at the address specified by the Buyer on the date specified by the Seller. The Buyer shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery.

4.2 The date of delivery specified by the Seller is an estimate only. Time for delivery shall not be of the essence of the contract.

4.3 If the Seller is unable to deliver the Goods for reasons beyond its control, then the Seller shall be entitled to place the Goods in storage until such times as delivery may be effected and the Buyer shall be liable for any expense associated with such storage.
4. LIEFERUNG

4.1 Sofern nichts anderes schriftlich vereinbart ist, erfolgt die Lieferung der Ware an die vom Käufer angegebene Adresse zu dem vom Verkäufer angegebenen Datum. Der Käufer hat alle notwendigen Vorkehrungen zu treffen, um die Waren bei jedem Angebot zur Lieferung abzunehmen.

4.2 Der vom Verkäufer angegebene Liefertermin ist nur eine Schätzung. Die Lieferfrist ist nicht Vertragsbestandteil.

4.3 Kann der Verkäufer die Ware aus Gründen, die außerhalb seines Einflussbereichs liegen, nicht liefern, ist der Verkäufer berechtigt, die Ware bis zu dem Zeitpunkt einzulagern, an dem die Lieferung erfolgen kann, und der Käufer haftet für die mit der Lagerung verbundenen Kosten.
5. RISK

7. HAFTUNG

8. FORCE MAJEURE
